1. Scope and Contracting Parties

These General Terms and Conditions (hereinafter "GTC") govern the business relationship between Drive2Flight GmbH, Scharnweberstr. 137, 13405 Berlin, represented by the Managing Director Yusuf Kirca (hereinafter "Drive2Flight" or "we"), and the users of our transport services (hereinafter "Customer" or "you").

Drive2Flight operates a booking platform for airport transfers and arranges transportation contracts between customers and transport companies commissioned by us. The actual transportation is carried out by our partner companies.

By making a booking through our website, app, or by telephone, you acknowledge these GTC as binding. Any conflicting or deviating terms and conditions of the Customer shall not become part of the contract unless we expressly agree to their applicability in writing.

The language of the contract is German.

2. Conclusion of Contract and Booking Confirmation

2.1. Booking Process

The booking process comprises the following steps:

  • Entry of the pick-up address, destination address, and desired pick-up date
  • Selection of the vehicle category and optional additional services
  • Entry of passenger details and contact information
  • Selection of the payment method
  • Review and confirmation of all details
  • Binding booking by clicking on "Book now with obligation to pay"

Before submitting the booking, all entered data will be displayed for your review. You may correct your entries at any time before submitting the booking.

2.2. Formation of the Contract

By submitting the booking, you make a binding offer to conclude a transportation contract. The contract is formed when we accept your booking by sending a booking confirmation by email. The booking confirmation contains all essential contractual data.

If we are unable to confirm your booking request within 24 hours, the offer shall be deemed rejected. In such a case, we will inform you without delay and refund any payments already made in full.

2.3. Trip Details and Driver Assignment

No later than 24 hours before the booked pick-up time, you will receive the trip details by email or SMS with the following information:

  • Name of the operating transport company
  • Name of the driver (if already known)
  • Vehicle type and licence plate (if already known)
  • Contact number for enquiries

3. Scope of Services and Obligations

3.1. Our Services

Drive2Flight arranges transportation services for airport transfers. The actual transportation is carried out by partner companies commissioned and contractually bound by us. Our services include:

  • Arrangement of a suitable transport company
  • Coordination and organisation of the trip
  • Provision of a booking system
  • Customer service before, during, and after the trip
  • Processing of payment and invoicing

3.2. Transportation Service

Transportation is provided from the specified pick-up address to the specified destination address. The price applies to the direct route without detours or intermediate stops, unless otherwise agreed. For fixed-price bookings, the payment obligation remains even if the passenger ends or shortens the trip prematurely.

The booked vehicle category guarantees the minimum equipment. We reserve the right to provide a higher-category vehicle without incurring additional costs for the Customer.

3.3. Service Area and Coverage

Drive2Flight exclusively offers airport transfers within the respective city area to the associated airport. Pick-up or drop-off is only available within the administrative city limits of the respective city in which we offer our services.

The following restrictions apply:

  • In Berlin: Trips only within the Berlin city area to Berlin Brandenburg Airport (BER) or from BER Airport to addresses within Berlin.
  • In other cities: The respective city limits and associated airport apply accordingly.
  • Outlying districts, suburbs, or municipalities outside the respective city limits are not served.
  • Bookings with pick-up or destination addresses outside the defined service area will not be accepted and may be rejected without stating reasons.

In case of doubt, please contact us before booking to clarify whether your desired address is within our service area.

3.4. Waiting Times and Delays

For pick-ups at the airport, a complimentary waiting period of 60 minutes after the scheduled landing time of the flight is included. This waiting period begins with the actual landing time, provided the flight number has been communicated to us. For all other pick-up locations, the complimentary waiting period is 15 minutes from the booked pick-up time.

After the complimentary waiting period has expired, waiting charges of EUR 0.50 per commenced minute may be applied, up to a maximum of EUR 30 per hour.

3.5. Customer Obligations

The Customer is obliged to:

  • Provide complete and accurate information when booking
  • Notify changes without delay (e.g. flight delays, address changes)
  • Be ready at the agreed pick-up location on time
  • Truthfully state the number of passengers and pieces of luggage
  • Register special requirements in advance (child seat, wheelchair, etc.)
  • Follow the driver's instructions during the trip

4. Prices and Payment Terms

4.1. Pricing

All stated prices are final prices and include the statutory value-added tax as well as all known ancillary costs (e.g. toll charges, parking fees). The price is displayed at the time of booking and stated in the booking confirmation.

For bookings where an exact price calculation is not possible at the time of booking (e.g. when the exact destination address is unknown), an estimated price will be provided. The final price will be calculated after the service has been rendered based on the actual distance and time driven.

4.2. Due Date and Payment

The total amount is due upon completion of the booking and will be debited immediately. The following payment methods are available:

  • Credit card (Visa, Mastercard, American Express)
  • Klarna

Payment is made exclusively online at the time of booking through our payment service provider Stripe. Cash payment to the driver is not possible. Tipping is not required.

The invoice for your booking can be found in your customer profile above the respective booking and is available for printing.

4.3. Additional Costs

Additional costs may arise in the following cases:

  • Exceeding the complimentary waiting period
  • Exceeding the stated luggage volume or number of passengers
  • Additional intermediate stops or detours at the Customer's request
  • Soiling or damage to the vehicle
  • Cancellation outside the free cancellation periods

5. Cancellation and Modifications

5.1. Cancellation by the Customer

Cancellations are only possible through our website, app, or by email to contact@drive2flight.com. Telephone cancellations are not accepted.

Cancellation deadlines and fees:

  • Up to 48 hours before the pick-up time: free of charge, full refund
  • Less than 48 hours before the pick-up time: 100% of the booking price
  • No-show (failure to appear): 100% of the booking price

The cancellation becomes effective upon receipt by Drive2Flight. You will receive a cancellation confirmation by email.

5.2. Modifications by the Customer

Modifications to the booking (e.g. date, time, pick-up address) are possible free of charge up to 24 hours before the booked pick-up time. Modifications within 24 hours of the pick-up time can only be made subject to availability and upon payment of a processing fee of EUR 15.

Modifications are only possible through our website, app, or by email to contact@drive2flight.com.

5.3. Cancellation by Drive2Flight

We reserve the right to cancel a booking if:

  • The execution of the trip is impossible due to force majeure
  • The Customer has provided false or incomplete information
  • No suitable partner company is available
  • The Customer is in breach of these GTC

In such cases, we will refund any payments already made in full. Further claims are excluded unless we are guilty of intent or gross negligence.

6. Right of Withdrawal for Consumers

Consumers generally have a statutory right of withdrawal. Please note, however, that the right of withdrawal expires for service contracts once we have fully performed the service, provided that performance only commenced after the consumer gave express consent and simultaneously confirmed awareness that the right of withdrawal is lost upon full performance of the contract by us.

By booking and accepting these GTC, you expressly declare that we shall commence performance of the service before the expiry of the withdrawal period, and you confirm your awareness that, by giving your consent, you lose your right of withdrawal upon full performance of the contract.

6.1. Withdrawal Notice

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period is fourteen days from the date of conclusion of the contract.

To exercise your right of withdrawal, you must inform us (Drive2Flight GmbH, Scharnweberstr. 137, 13405 Berlin, email: contact@drive2flight.com, tel: 03040729999) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or email).

Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse all payments received from you without undue delay and no later than fourteen days from the day on which we received notification of your withdrawal from this contract. For this reimbursement, we shall use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event shall you be charged any fees as a result of such reimbursement.

If you have requested that the services should commence during the withdrawal period, you shall pay us a reasonable amount corresponding to the proportion of services already provided up to the point at which you notify us of the exercise of the right of withdrawal with regard to this contract, compared with the total scope of services provided for in the contract.

7. Liability and Warranty

7.1. Liability of Drive2Flight

We are liable without limitation for damages resulting from injury to life, body, or health caused by an intentional or negligent breach of duty by us or our legal representatives or vicarious agents.

For other damages, we are only liable in the event of a breach of a material contractual obligation (cardinal obligation), but limited in amount to the damages foreseeable at the time of conclusion of the contract and typical for the type of contract, provided the damage is based on simple negligence. Material contractual obligations are those whose fulfilment is essential to the proper performance of the contract and on whose compliance the Customer may regularly rely.

The foregoing limitations of liability do not apply in the case of fraudulent concealment of a defect or assumption of a guarantee. Liability under the German Product Liability Act remains unaffected.

7.2. Liability for Partner Companies

As the transportation is carried out by our partner companies, the operating transport company is primarily responsible for damages during the trip. This includes in particular:

  • Accidents and personal injury during the trip
  • Loss, damage, or theft of luggage
  • Delays due to traffic or technical problems

We ensure that all partner companies maintain adequate insurance cover and will assist you in asserting claims against the transport company.

7.3. Luggage and Personal Belongings

The Customer is responsible for ensuring that carried luggage and personal belongings are properly stowed. We recommend not transporting valuables in the luggage compartment. Liability for loss or damage to luggage is limited to EUR 500 per passenger, unless intent or gross negligence is established.

8. Force Majeure

We are released from our performance obligations if fulfilment becomes impossible due to events of force majeure. Events of force majeure include in particular: natural disasters, war, terrorist attacks, strikes, governmental orders, severe storms, pandemics, and other unforeseeable and unavoidable events beyond our control.

In cases of force majeure, payments already made will be refunded in full. Further claims are excluded.

9. Data Protection

The protection of your personal data is important to us. The collection, processing, and use of your data is carried out exclusively in accordance with the applicable legal provisions. Detailed information on data protection can be found in our Privacy Policy, available at www.drive2flight.com/datenschutz.

10. Final Provisions

10.1. Applicable Law

The law of the Federal Republic of Germany shall apply exclusively, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). If the Customer is a consumer and had their habitual residence in another country at the time of booking, the application of mandatory legal provisions of that country shall remain unaffected.

10.2. Place of Jurisdiction

If the Customer is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contractual relationship shall be Berlin.

10.3. Severability Clause

Should individual provisions of these GTC be or become invalid, this shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a provision that most closely approximates the economic purpose of the invalid provision.

10.4. Amendments to the GTC

We reserve the right to amend these GTC at any time. Amendments will be notified to the Customer by email. The amended GTC shall be deemed approved if the Customer does not object within four weeks of receipt of the notification. We will draw attention to this legal consequence in the notification.

10.5. Online Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR), which can be found at https://ec.europa.eu/consumers/odr/. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
